Where a business, or part of a business, is sold and employment is transferred, many of the basic terms and conditions of employment may still be protected by TUPE, but before any transfer of employment takes place, there should be a proper consultation and employees have the right to be given information through their representatives about the transfer. This includes when it is likely to happen, the reason for it and any legal, economic or social implications. The new employer is also duty bound to state whether any terms and conditions are planned for employees.
